These Terms and Conditions (“the Terms and Conditions”) govern your (“the User”) use of the Vinylla Designs (“Provider”) website located at the domain name www.vinylladesigns.co.za (“the Website”). By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out in this legal notice. The User may not access, display, use, download, and/or otherwise copy or distribute Content obtained on the website for marketing and other purposes without the consent of the Provider.
By using this Website or communicating with the Provider by electronic means, the user consents and acknowledges that any and all agreements, notices, disclosures, or any other communication satisfies any legal requirement, including but not limited to the requirement that such communications should be in writing.
E-Commerce & Privacy
The Website www.vinylladesigns.co.za sells vinyl wall art and stickers online. The use of any product or service bought from this Website is at the purchaser’s risk. The purchaser/ user indemnifies and holds the Provider harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website.
The private information required for executing the orders placed through the e-commerce facility, namely the User’s personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Only the necessary information, that is the delivery address and contact phone number will be made known to third parties delivering the product. Credit card details are not kept by the Provider under any circumstances.
The Provider cannot be held responsible for security breaches occurring on the User’s electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.
The Provider will supply all goods to the delivery company in good order. The Provider will not be held liable for the condition of goods arriving at the User’s chosen delivery address.
Payment Options and Pricing
All transactions will be processed in South African Rands (ZAR). The Provider endeavors to offer you competitive prices on current products. The User’s total order price will include the price of the purchase plus any applicable shipping charges on the day of shipping. Payment may be made via Visa or MasterCard Credit Cards, via PayFast or Electronic Funds Transfer (EFT)/Cash Deposit into the the Provider’s bank account, the details of which will be provided during checkout. Please note that orders using the EFT/Cash Deposit will only be dispatched once the payment has cleared in the Provider’s bank account.
Provider reserves the right to change pricing at any time without prior notice. No request for a refund of the difference between the price the User was charged outside of any promotional period and the reduced price will be accepted or processed.
PayFast secure online credit card processing
All online credit card payments are processed via PayFast. Card Holders may go to www.payfast.co.za to view PayFast’s security policies.
Ownership of products ordered will pass to the User upon Vinylla Designs receiving full payment for such products. Delivery will only take place on orders that have been paid in full. The Provider accepts no responsibility for delivery delays. The delivery address is that which is specified on the web order form. Risk of loss of the goods passes to the User upon dispatch of the product for delivery.
When the goods are dispatched; the user will receive an email confirming the shipping method and also the tracking number.
Refund and Return Policy
Any complaints regarding the standard and quality of the product or products bought by consumers through the e-commerce facility should be directed to Nicolien at Customer Care at firstname.lastname@example.org.
If the product was damaged during transit the User must notify the Provider of such damage within 48 hours of receipt of delivery. After such time has passed it is accepted that the User has accepted the delivery.
If the User has not altered the vinyl decal in any way and has not cut, used or stuck it onto the wall or any appropriate surface; then the cooling off period applies and the User may get a full refund by emailing the Provider within 7 days of receipt and then returning the unused goods to the Provider in the original packiging and undamaged condition. The user will need to send the original package back to the Provider at the User’s own expense using a traceable delivery method in order for the Provider to inspect the goods prior to the refund being given. The tracking number must be emailed to the Provider at email@example.com.
If the vinyl decal is defective and the User has already cut or stuck it onto the wall or any appropriate surface, the Provider will replace the defective parts or whole sticker using the same delivery method as with the original order.
* Note: The Provider recommends that the User uses Speed Services Couriers (South African Postal Services) for all returns as it offers shipment tracking through a 24 hours customer helpline. Should the User choose to use a carrier that does not offer a tracking facility and the goods are lost then no refund or return will be considered.
The Provider’s refunds and returns policy does not apply to rough or textured walls or any other inappropriate application of the vinyl decals such as on textiles or high temperature surfaces. The Provider does not accept liability for vinyl decals that have been inappropriately/wrongly applied or damaged by the User.
International refunds and returns
No refunds and returns on international orders as the Provider’s refund and returns policy is only valid in the Republic of South Africa.
Cancellation of order
Cancellation of orders by the User must be done within 12 hours of ordering via www.vinylladesigns.co.za. After this period, orders cannot be cancelled as it will already be in production. Cancellation has to be done via e-mail within 12 hours, confirmed by Customer Care and any costs such as credit card fees or any other fees that have been incurred by the Provider will be deducted from the total amount to be refunded. Cancellation of custom orders will be charged at 50% of the quoted price.
In the event of circumstances beyond the Provider’s control, the Provider is not liable for delays in performance and completion. The Provider will exercise a time extension for performance in the following situations: strikes, fire, war, acts of terror, shortages in stock, exchange fluctuations, currency shortages, riots, violent disorder, shortage in transportation, governmental or regulatory action, natural disasters, or shortages or delays in deliveries from suppliers or manufacturers or any other event that causes the same result. Either party can terminate the agreement for sale without compensation after 60 (sixty) days or any time thereafter.
Updating of these Terms and Conditions
Provider reserves the rights to change, modify, add or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the User’s obligation to periodically check these Terms and Conditions at the Website for changes or updates. The User’s continued use of this Website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.
Copyright and Intellectual Property Rights
Provider provides certain information at the Website. Content currently or anticipated to be displayed at this Website is provided by Provider, its affiliates and/or subsidiary, or any other third party owners of such content, and includes but is not limited to Literary Works, Musical Works, Artistic Works, Sound Recordings, Cinematographic Films, Sound and Television Broadcasts, Program-Carrying Signals, Published Editions and Computer Programs (“the Content”). All such proprietary works, and the compilation of the proprietary works, are copyright the Provider, its affiliates or subsidiary, or any other third party owner of such rights (“the Owners”), and is protected by South African and international copyright laws. The Providers reserve the right to make any changes to the Website, the Content, or to products and/or services offered through the Website at any times and without notice. All rights in and to the Content is reserved and retained by the Owners. Except as specified in these Terms and Conditions, the User is not granted a license or any other right including without limitation under Copyright, Trademark, Patent or other Intellectual Property Rights in or to the Content.
Limitation of liability
The Website and all Content on the Website, including any current or future offer of products or services, are provided on an “as is” basis, and may include inaccuracies or typographical errors. The Owners make no warranty or representation as to the availability, accuracy or completeness of the Content. Neither Provider nor any holding company, affiliate or subsidiary of Provider, shall be held responsible for any direct or indirect special, consequential or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the Content or the Website or any functionality thereof, or of any linked website, even if Provider is expressly advised thereof.
The provider will not be held liable for any death, injury, disability to any person or damage to any property caused in direct or indirect relation to the use of any product sold by Vinylla Designs. Please note that the vinyl decals could pose a chocking hazard if put up within reach of small children.
Privacy: Casual surfing
The User may visit the Website without providing any personal information. The Website servers will in such instances collect the IP address of the User computer, but not the email address or any other distinguishing information. This information is aggregated to measure the number of visits, average time spent at the Website, pages viewed, etc. Provider uses this information to determine use of the Website, and to improve Content thereon. Provider assumes no obligation to protect this information, and may copy, distribute or otherwise use such information without limitation.
Choice of Law
This Website is controlled, operated and administered by Provider from its offices within the Republic of South Africa. Access to the Website from territories or countries where the Content or purchase of the products sold on the Website is illegal is prohibited. The User may not use this Website in violation of South African export laws and regulations. If the User accesses this Website from locations outside of South Africa, that User is responsible for compliance with all local laws. These Terms and Conditions shall be governed by the laws of the Republic of South Africa, and the User consents to the jurisdiction of the Witwatersrand High Court in the event of any dispute. If any of the provisions of these Terms and Conditions are found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue in full force and effect. These Terms and Conditions constitute the entire agreement between the Provider and the User with regard to the use of the Content and this Website.
